I am driving on the hwy when cut off bye a John Doe. I hit another car driven by an illegal with no drvr lic?
and a child is killed not wearing a seat belt. Whose at fault? Will the court mitagate damages because the person driving did not have a driver’s lic and their child wasn’t wearing a seatbelt?
You hit the other car? If the other driver didn’t contribute anything to the accident other than being there, it is your fault. You don’t avoid being hit by hitting somebody else.
If the other driver is unlicenced, it means nothing to you, he will be charged for that offence separately. If the child wasn’t wearing a seatbelt, the driver will face charges for that. However, that doesn’t mitigate any offence you may be charged with if you were driving the vehicle doing the hitting.
